HON'BLE SRI JUSTICE SURESH KUMAR KAIT WRIT PETITION No.13715 of 2016 ORDER:

Vide the present petition, the petitioner seeks Mandamus declaring the impugned award proceedings vide Ref.No.C1/18/2015, dated 21.09.2015 issued by respondent No.3 in respect of the land to an extent of Ac.3.72 cents in R.S.No.273/2 of Darbagudem Village, Jeelugumilli Mandal, West Godavari District, as illegal, arbitrary and violation of principles of natural justice as well as Act 30 of 2013 and consequently to direct respondent No.3 to conduct fresh award enquiry on the acquired land of the petitioner in question, by considering the petitioners' representation/objection dated 29.10.2015. Learned counsel for the petitioner submits that to the relief sought in the instant petition, the petitioner has made representation/objection on 29.10.

2015 to the Special Collector (Land Acquisition) Polavaram Irrigation Project, Rajahmundry as well as to respondents No.2 and 3. However, till date no decision has been taken by the respondents. He further submits that let respondent No.3 be directed to conduct fresh award enquiry on the acquired land of Ac 3.72 cents in the property mentioned above.

In view of the facts and circumstances of the case and the submissions made by learned counsel for the petitioner, I hereby direct respondent No.3 to take decision on the representation/objections filed by the petitioner, dated 29.10.2015, within four (04) weeks from the date of receipt of a copy of this order.

With the above direction, this Writ Petition is disposed of. No costs. Pending miscellaneous petitions, if any, shall stand closed.
