THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2753 OF 2015 ORDER:

This criminal revision case under Sections 397 and 401 of the Code of Criminal Procedure is filed by the petitioners/A.1 to A.8 seeking to set aside the order, dated 03.11.2015 passed in C.C. No.343 of 2014 by the Court of the II Additional Judicial First Class Magistrate, Machilipatnam. Heard and perused the material.

Learned counsel for the petitioners submits that the Court below passed an erroneous order and issued Non Bailable Warrants (NBWs) against the petitioners herein even though the interim order, dated 14.11.2014, passed in Crl.P.No.13412 of 2014 by this Court, dispensing with the presence of the petitioners except on the dates when their presence is specifically required by the Court below.

Considering the facts and circumstances, the petitioners/A.1 to A.8 are directed to appear before the Court below and file an application for recalling NBWs issued against them, and on filing of such application, the Court below is directed to recall the NBWs issued against the petitioners/A.1 to A.8 on the same day on condition of each of them executing a personal bond for a sum of Rs.5,000/- (Rupees five thousand only) with one surety for the like sum each to the satisfaction of the said Magistrate. Further, the presence of the petitioners/A.1 to A.8 before the trial Court is dispensed with except on the dates when the trial Court insists for their appearance.

The Criminal Revision Case is accordingly disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 17.11.2015 pln
