THE HON'BLE DR. JUSTICE SHAMEEM AKTHER CRIMINAL REVISION CASE NO.1749 OF 2006 ORDER:

This revision is filed by the petitioner-accused under Sections 397 and 401 Cr.P.C. challenging the judgment, dated 18.10.2006 in Crl.A.No.66 of 2006 on the file of the III Additional Sessions Judge, Karimnagar, in confirming the conviction of the petitioner for the offence punishable under Section 509 IPC and sentencing him to undergo simple imprisonment for three months and to pay fine of Rs.500/-, in default to suffer simple imprisonment for one month, recorded by the Addl. Judl. Magistrate of I Class, Karimnagar, vide judgment, dated 17.03.2006 in C.C.No.627 of 2004. 2.

Heard learned counsel for the petitioner-accused, learned Assistant Public Prosecutor representing the respondent-State and perused the record.

As far as material evidence and documents are concerned, the same were properly appreciated by both the Courts below. The petitioner is a young person. Therefore, a lenient view can be taken in imposing sentence against the petitioner.

Therefore, imposition of sentence of simple imprisonment for a period of three months for the offence punishable under Section 509 IPC is modified to pay a fine of Rs.1,000/- in addition to payment of fine of Rs.500/- already imposed.
