This writ petition is filed challenging the notice dated 17.03.2017 issued vide Notice No.G/400/2017 by the 3rd respondent and trying to cancel the registered document No.6097 of 2016, dated 08.11.2017 pertaining to house property bearing Door No.3-4-86, Giddangi Street, TS.No.1602, 3rd Ward, Tirupati Urban Mandal, Tirupati Municipal Corporation, Chittoor District basing on the complaint made by the 5th respondent. Learned counsel for the petitioner submits that when petitioner approached the 3rd respondent in person, he was informed that his documents will be cancelled. Heard the learned Assistant Government Pleader for Revenue.
It is not the case of the petitioner is that impugned notice is without jurisdiction. Normally, this Court will not interfere with show cause notice.
Having issued notice, it is for the 3rd respondent to consider the explanation of the petitioner and pass orders. In view of the same, it is open for the petitioner to submit explanation to the impugned notice dated 17.03.2017 along with necessary documents and on such explanation being filed, the 3rd respondent is directed to consider the same and pass orders and take necessary action, after giving an opportunity of hearing to the petitioner as well as the 5th respondent.
With the above observation, the writ petition is disposed of. No costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 07.04.2017 dv
