HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.4097 OF 2011 ORDER:

Decree holder is the revision petitioner. The EP filed under Order XXI Rules 37 and 38 CPC is dismissed by the trial Court on the ground that the decree holder failed to prove that the judgment debtor has means and is still evading and avoiding to pay the decretal amount.

After perusing the findings recorded by the executing Court, I am satisfied that no ground warranting interference is made out. Revision fails and is, accordingly, dismissed. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
