THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE T.AMARNATH GOUD WRI T PETI TI ON No. 16086 of 2019 ORDER: (per SK,J) The prayer of the petitioner in this writ petition reads as under: 'For the reasons stated in the accompanying affidavit, It is therefore prayed that this Hon'ble Court may be pleased to issue a writ, order or direction more particularly one in the nature of Writ of Mandamus or any other appropriate writ (i) declare the action of the Respondent-University in not permitting the Petitioner to participate in the verification of the certificates in pursuance to notification is illegal, and arbitrary; (ii) direct the Respondent No.2 to permit the Petitioner to take part in the third Counseling for admission into MBBS/BDS course in pursuance of the notification dated 21.06.2019 and further admit the Petitioner into MBBS/BDS course as per the rank secured by her and her eligibility under competent authority quota seats; (iii) pass such order or other orders as this Hon'ble Court may deem fit and proper in the interest of justice.'
Sri G.Ravi, learned counsel representing Sri A.Prabhakar Rao, learned counsel for the second respondent University of Health Sciences, Warangal, would inform this Court that it is too late in the day for the petitioner to now seek consideration of her case for admission into MBBS/BDS Course during the academic year 2019-20. He would point out that the petitioner is claiming reservation under ST category as well as economically weaker section category and certificate verification would be essential to verify her status. He would further point out that the second phase of counselling for admission to these courses has already been completed.
Though the petitioner claims that she was unwell and could not therefore come forward to participate in the certificate verification at the prescribed time on the prescribed date, we find that even as per the medical records filed by the petitioner, she was discharged from the hospital as long back as on 05.07.2019. There is no explanation forthcoming as to why the petitioner did not come before this Court
immediately thereafter. It may be noted that in cases of this nature, interim orders were granted from 07.07.2019 onwards but at this late stage, it is not open for the petitioner to seek any indulgence. The delay on the part of the petitioner in coming before this Court is fatal. The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
