This Criminal Petition is filed under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner/accused to enlarge him on bail in connection with Crime No.195 of 2025 on the file of the Malkajgiri Police Station, Rachakonda, registered for the offence punishable under Sections 109, 126(2), 352 and 351(2) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

Heard Sri Lattupally Anand, learned counsel for the petitioner/accused and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent/State. 3.
It is the case of the prosecution that initially Malkajgiri Police Station, Rachakonda, registered a case in Crime No.195 of 2025 against the petitioner/sole accused for the offence punishable under Sections 118(1), 352 and 351(2) read with Section 3(5) of BNS and subsequently, the same
were altered to Sections 109, 126(2), 352 and 351(2) read with Section 3(5) of BNS.

Learned counsel for the petitioner/accused submits that the petitioner was arrested on 20.03.2025 and is in judicial custody since then.
The petitioner/accused filed Crl.M.P.No.241 of 2025 before learned III Additional District and Sessions Judge-cum-II Additional Metropolitan Sessions Judge, Medchal-Malkajgiri District at Kukatpally, seeking regular bail and the same was dismissed on 15.05.2025 as investigation is pending.

Learned Additional Public Prosecutor submits that the investigation has been completed, the charge sheet was filed on 23.05.2025 and PRC number is awaited.

Having considered the submissions made by the learned counsel for the respective parties and since the entire investigation is completed, the question of petitioner/accused influencing the witnesses does not arise. Hence, the petitioner/accused is entitled to be enlarged on bail, subject to the following conditions:
(i) The petitioner/accused shall be released on bail on his executing a personal bond for a sum of Rs.25,000/-(Rupees twenty five thousand only) with two sureties for a like sum each to the satisfaction of learned III Additional District and Sessions Judge-cum-II Additional Metropolitan Sessions Judge, Medchal-Malkajgiri District at Kukatpally.
(ii) The petitioner/accused shall abide by the other conditions stipulated in Section 480(3) of BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
