The relief sought for in this writ petition is to declare the action of the 2nd respondent in not passing any order on the stay petition filed along with the appeal dated 06.05.2015 filed against the proceedings No.J/646/2015, dated 02.05.2015 passed by the 3rd respondent, whereby the petitioner's authorization was suspended without conducting enquiry as illegal and arbitrary and to consequently direct respondents 3 and 4 to release the essential commodities pertaining to fair price shop No.41, M Vemulapadu Village, Santhanuthalapadu Mandal, Prakasam District in favour of the petitioner for distributing the same to the cardholders.
Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies.
The innocuous prayer sought for in this writ petition is to direct the 2nd respondent to pass appropriate orders on the stay application filed by the petitioner along with the appeal.
Therefore, the writ petition is disposed of directing the 2nd respondent to take appropriate decision in the matter after giving reasonable opportunity to the petitioner within a period of two (2) weeks from the date of receipt of a copy of this order.
