HON'BLE SRI JUSTICE A. SHANKAR NARAYANA CIVIL REVISION PETITION No.1895 OF 2017 ORDER:
On the ground that the suit in O.S.No.25 of 2001 on the file of learned I Additional District Judge, Nizamabad, is of the year 2001, and, though, dealt with by four presiding officers, but no result yielded, the present revision petition, under Article 227 of the Constitution of India, is filed requesting to direct the learned I Additional District Judge, Nizamabad, to dispose of the suit as expeditiously as possible by fixing a reasonable time frame.
2. Heard Sri M. Karuna Sagar, learned counsel for the revision petitioner.
3. It is no doubt true, the present request is made under Article 227 of the Constitution of India, but it is doubtful whether such a direction can be given and if given, what would be its effect on the cases pending on the file of various Courts. Therefore, at the outset, it is to be stated, in the absence of any specific ground, so as to compel this Court to grant such a direction in the revision petition, such a request cannot be acceded to.
4. However, keeping in view, that the suit relates to the year 2001 and as it is represented by the learned counsel for petitioner that the suit is coming up for hearing, the learned I Additional District
Judge, Nizamabad, is advised to take note of the long pendency of the Suit and act in accordance with law.
5. With the above observation, the present revision petition is disposed of. Miscellaneous Petitions, if any, pending in this revision petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J June 30, 2017.
