When the matter is listed on 07.11.2016, there is no representation on behalf of the petitioner and the learned Standing Counsel for the Central Government submits that the petitioner had not appeared before the Medical officer and absconding from the date of discharge i.e., from 21.08.2009, without any permission from the Controlling Authority and that his pay and allowance can be paid only on his returning to duty. As such, this Court directed to post the matter under the caption 'for dismissal'.
Even when the matter is listed today under the caption 'for dismissal', there is no representation on behalf of petitioner. This shows that the petitioner is not evincing any interest in prosecuting the matter diligently.
Hence, the Writ Petition is dismissed for non prosecution. No order as to costs.
