HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.13274 OF 2009 ORDER:

The order in Proc.No.D.II-1/2009-FC-II, dated 19.06.2009, passed by the 1st respondent terminating the services of the petitioner, is challenged in this Writ Petition. This writ petition is filed on the ground that there was a violation of principles of natural justice apart from invoking the provisions of CCS (Temporary Service) Rules, 1965, which are untenable to the petitioner's case.

The writ petition came to be admitted on 13.07.2009 and this Court suspended the impugned order dated 19.06.2009 making it clear that the writ petitioner shall be continued in service as a Constable, even if he has been relieved pursuant to the impugned order. Later, Vacate Petition filed by the respondents also came to be dismissed as withdrawn by an order dated 30.08.2010. When the matter is taken up for hearing, learned counsel appearing for the respondents fairly submits that pursuant to the order of this Court dated 13.07.2009, the respondent authorities have reviewed the case of the petitioner and having accepted the explanation submitted by the petitioner had reinstated him to the service. In that view of the matter, nothing survives in this writ petition as the relief sought by the petitioner stands granted by the respondent authorities themselves.

Accordingly, the Writ Petition is closed. There shall be no order as to costs. Miscellaneous petitions pending, if any, shall stand closed.
