HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16136 of 2019 ORDER:

This writ petition is filed assailing the action of official respondents more particularly respondents 3 and 4 in interfering with the peaceful possession and enjoyment of the property bearing Sy.No.47/AA, admeasuring to an extent of Ac.5-08 guntas situated at Pudur Village, Medchal Mandal, Medchal Malkajgiri District belongs to the petitioners.

Learned Assistant Government Pleader for Home produced written instructions stating that a case in Cr.No.432 of 2019 is registered against petitioners and one Nikhil Reddy and investigation has been taken-up. The other allegations made by the petitioners are denied. It is stated that notices under Section 41-A Cr.P.C. were issued to petitioners on 28-07-2019 and again on 29-07-2019.

In view of the same, the writ petition is disposed of directing the respondent-police not to interfere with the civil disputes pending between the petitioners and unofficial respondents. However, this order will not preclude the respondent-police from investigating into any crime.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
