HON'BLE SRI JUSTICE S.V. BHATT W.P.No.23955 OF 2016 ORDER:

The petitioners pray for the following relief: "....this Hon'ble Court may be pleased to issue an Order or Direction, more particularly one in the nature of Writ of Mandamus, directing the respondents 1 to 3 not to interfere with petitioners'

peaceful possession and enjoyment of their lands situated in Sy.Nos.2730/1, 2730/2, 2730/4, 2730/5 total Acs.5-00 in Pedda Orampadu village fields of Obulavaripalli Mandal of YSR Kadapa District, without due process of law, and pass ....." The prayer is against threatened dispossession of petitioners from the lands referred above without recourse to law. On 29.07.2016, this Court granted interim stay of dispossession of the petitioners from the subject lands.

The prayer in the writ petition is to follow the procedure stipulated by law before dispossessing the petitioners from the lands. The prayer of petitioners insists following rule of law. Hence, the writ petition is disposed of by directing respondent No.3 to issue notice to petitioners on the aspects pointed out in the written instructions dated 03.07.2017 within four weeks from today. Thereafter, the petitioners are given four weeks' time to file reply to the show cause notice of 3rd respondent. The 3rd respondent conducts enquiry and passes order within four weeks thereafter. Having regard to the above directions, the parties are directed to maintain status quo as on date as regards possession and physical

features for a period three months. There shall be no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
