THE HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR WRIT PETITION No.43097 OF 2015 ORDER:

Heard learned counsel for the petitioner and learned Government Pleader for Revenue.

The petitioner's grievance is that the appeal No.Rc.E/173/2015 pending before the Revenue Divisional Officer, Adoni Revenue Division, Kurnool District, the 3rd respondent, though heard and reserved, is not yet disposed of. It is evident from the record that as many as four different dates were notified by the 3rd respondent and finally on 20.06.2015 the appeal was stated to have been heard and reserved for orders. The petitioner has now filed a copy of letter, dated 20.08.2015, said to have been filed by the Former Tahsildar, Gonegandla Mandal, Kurnool District, to the 3rd respondent, denying his signatures and I.D. number on the pattadar pass book and title deeds issued in favour of the 5th respondent. Based on the same, now the petitioner sought not only for disposal of the appeal, but also for prosecution of the 5th respondent.

At this stage, it is premature to examine the contention of the petitioner inasmuch as his appeal has been heard and reserved for orders by the 3rd respondent and it is only after the orders of the 3rd respondent, taking up further steps, if any, would arise. Merely on the basis of letter, dated 20.08.2015, of the Former Tahsildar, the petitioner's request as sought for in the prayer cannot be considered. Since the appeal is already pending, the 3rd respondent shall consider and dispose of the same in accordance

with law. However, the petitioner is at liberty to take appropriate steps, if he is aggrieved by the orders of the 3rd respondent.

The Writ Petition is accordingly disposed of. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
