THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.5625 OF 2005 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a Writ of Mandamus declaring the action of the first respondent in prescribing the qualification of Degree and Post Graduate Degree in Sociology contrary to Rule 72 of the Mines Rules 1955 as illegal, arbitrary and consequently direct the respondents to treat the petitioner as fully qualified and eligible to hold the post of Welfare Officer (Trainee) in terms of Rule 72 of Mines Rules 1955 and consider his candidature on par with the other candidates basing on his performance and appoint him as Welfare Officer (Trainee). The learned counsel for the respondents submitted that the very purpose of filing the writ petition has become infructuous. In view of the above, the Writ Petition is dismissed as infructuous. However, dismissal of this writ petition does not preclude the petitioner to make an application for the post of Welfare Officer (Trainee), if the vacancies arise in future and if he is otherwise qualified. No costs.

Consequently, Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
