THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CRIMINAL APPEAL No.882 OF 2009 JUDGMENT:
This appeal, under Section 374 (2) of the Code of Criminal Procedure, (for short, 'Cr.P.C') is filed by the appellant/accused aggrieved by the judgment, dated 30.04.2009, rendered in Sessions Case No.439 of 2008 on the file of III Additional Sessions Judge (Fast Track Court), Asifabad, whereunder and whereby, the learned Sessions Judge found the appellant/accused guilty of the offence punishable under Section 304-II IPC and accordingly, he was convicted and sentenced to undergo rigorous imprisonment for a period of seven years and to pay fine of Rs.500/-, in default to suffer simple imprisonment for five months.

Heard the learned Additional Public Prosecutor appearing for the respondent-State. There is no representation for the appellant/accused, though the matter is listed under caption "for orders". Perused the record.

As seen from the record, the impugned judgment was passed on 30.04.2009. This Court did not grant any suspension of sentence in the appeal. It appears from the record, the appellant/accused had served the sentence of imprisonment imposed by the Court below.

Under these circumstances, the appeal is dismissed as infructuous.
Miscellaneous Petitions, if any, pending in this appeal shall stand closed.
