THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY TRANSFER CRIMINAL PETITION No.192 of 2015 ORDER:

This petition is filed under Section 407 Cr.P.C., to withdraw the proceedings in C.C.No.93 of 2013 on the file of the II Additional Judicial First Class Magistrate, YSR Kadapa District and to transmit the same to any competent Court at Hyderabad/Ranga Reddy district.

2. Heard both sides.

3. Learned counsel for the first respondent assures safety of the petitioner whenever he attends the Court at Kadapa.

4. Learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw transfer criminal petition with a liberty to file a petition under Section 205 Cr.P.C. before the trial Court.

5. Permission is granted.

6. Accordingly, this Transfer Criminal Petition is dismissed as withdrawn granting liberty as prayed for. If the petitioner files the petition under Section 205 Cr.P.C., the trial Court is hereby directed to pass appropriate orders thereon by taking into consideration the grievance of the petitioner. Miscellaneous petitions, pending if any, shall stand closed.
