HON'BLE THE CHI EF JUSTI CE SRI THOTTATHI L B. RADHAKRI SHNAN TRANSFER CRI MI NAL PETI TI ON No.11 of 2015 ORDER:

This is an application seeking transfer of C.C.No.524 of 2014 pending on the file of II Additional Judicial Magistrate of First Class, Eluru, West Godavari District, to the Court of XIII Additional Chief Metropolitan Magistrate, Hyderabad.

The second respondent - de facto complainant lodged a complaint alleging offences punishable under Sections 498(A) and 406 I.P.C read with Sections 3 and 4 of Dowry Prohibition Act, 1961, based on which, the above C.C. was registered. Though there are five accused persons in the said case, only the petitioner, who is arrayed as Accused No.1, sought transfer of the case. I do not see any ground for transfer of the case of such nature. That apart, the jurisdictional Court is the one which holds primary territorial jurisdiction and no sustainable reasons are demonstrated for transfer of this case. 3.

Hence, the Transfer Criminal Petition is dismissed. Pending miscellaneous petitions, if any, shall also stand dismissed.
