The petitioner/accused No.8 filed the present application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita 2023 (BNSS), seeking to grant pre-arrest bail to him in FIR No.651 of 2025 of Allapur Police Station, Cyberabad Commissionerate, which was registered for the offence punishable under Sections 61(2), 109 read with Section 3(5) of the Bharatiya Nyaya Sanhita 2023 (BNS).

Heard Mr. Seelam Srinivas Rao, learned counsel for the petitioner and Mr. M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State.

Learned counsel for the petitioner submitted that earlier petitioner along with other accused filed Crl.P.No.3745 of 2026 before this Court seeking anticipatory bail, which was disposed of by this Court by order dated 24.03.2026, granting anticipatory bail to other accused except petitioner on the ground that the petitioner was not arrayed as accused in FIR No.651 of 2025. However, subsequent to order passed by this Court, Police have filed Memo dated 26.03.2026 before the learned I Addl. Junior Civil Judge-cum-XII Addl. Metropolitan Magistrate, MedchalMalkajgiri District, stating that due to oversight, the name of petitioner was not included in remand report and sought permission to array him as accused in the above crime. As the petitioner apprehends arrest, he prays to grant pre-arrest bail.

On the other hand, learned Assistant Public Prosecutor filed counter affidavit and stated that petitioner is not co-operating with the investigation with Police authorities. It is stated that petitioner along with accused Nos.5 to 7 are main conspirators of the offence and their phone data is yet to be evaluated. The Investigating Officer has also served notice under Section 94 of BNSS to the petitioner but he is not cooperating with the investigation and opposed the grant of pre-arrest bail to the petitioner.

In view of the facts and circumstances of the case and taking into consideration the gravity of the offence alleged against the petitioner, and accused Nos.5 to 7 were already granted pre-arrest bail by this Court by the Crl.P.No.3745 of 2026 dated 24.03.2026 this Court deems it fit to grant anticipatory bail to the petitioner/accused. 7.

Accordingly, this Criminal Petition is allowed and the petitioner/ accused No.8 shall be released on anticipatory bail on the following terms and conditions:

i.

The petitioner shall surrender before the Station House Officer, Allapur Police Station, Cyberabad Commissionerate, within two

(2) weeks from today and on such surrender, the said Station House Officer shall release him on bail on his executing a personal bond for Rs.25,000/- with two sureties, for the like sum each. ii.

The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case. iii.

The petitioner shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m. and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
