.. Respondents The Court made the following:

ORDER:

The petitioners claim to be the absolute owners of various extents of lands mentioned in paragraph No.3 of the affidavit filed in support of the writ petition situated in Bulkapur Village, Shankerpally Mandal, Ranga Reddy District. Petitioners allege that the respondent authorities started widening of the road from Shankerpally to Hyderabad passing through their village and in that process private patta lands adjacent to the existing road are situated and respondents are utilizing their lads for widening of the road.

According to the petitioners, the existing road width is 50 feet, whereas the proposed road width is 100 feet and in between this extent, they are having patta lands. Therefore, they should not be dispossessed from the said lands without following due process of law.

According to the learned Government Pleader, representing Roads and Buildings Department, there is an existing right of way belonging to the Roads and Buildings Department; that road widening work is taken up within the extent of road width approved by the Roads and Buildings Department; and that the respondent authorities are not utilizing the private lands of the petitioners for the purpose of widening and strengthening of the road.

Learned Government Pleader, representing the Land Acquisition, also informed the Court that no land acquisition

proceedings have been initiated to acquire the private lands of the petitioners.

Having regard to the submissions of learned Government Pleaders, the apprehension expressed by the learned counsel for the petitioners no more survives.

Accordingly, the Writ Petition is disposed. It is needless to observe that if the private lands of the petitioners are required for the purpose of road widening, the respondent authorities shall follow due process of law before dispossessing the petitioners from their subject lands.
