HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.39471 OF 2016 ORDER:

The present writ petition is filed by the petitioner seeking to declare the inaction of the 1st respondent in disposing of the appeal filed by the petitioner on 20.09.2016, against orders, dated 24.09.2014, passed by 2nd respondent in Proceedings Rc.No.1515/ 2013/ C4, as illegal and arbitrary, and consequently, direct the 1st respondent to dispose of appeal as expeditiously as possible.

Heard and perused the material available on record. The case of the petitioner is that she applied for the post of Secondary Grade Teacher, in pursuance to the DSC-2012 Notification, reserved for the BC-E Group candidates. One Razia Begum was selected for the said post since she is meritorious than the petitioner. The petitioner made a representation before the 2nd respondent alleging that said Razia Begum has fraudulently obtained BC-E caste certificate by misrepresenting the authorities concerned. After enquiry, the 2nd respondent issued orders, dated 24.09.2014, holding that the Muslim Katia (BC-E), certificate issued by the authority concerned, to the said Razia Begum is genuine. Aggrieved by the same, the petitioner filed an appeal before the 1st respondent on 20.09.2016. The grievance of the petitioner is that though the appeal is filed on 20.09.2016, till date the 1st respondent has not passed any orders on the appeal and the appeal should be disposed of within a period of thirty days from the date of its filing.

Considering the facts and circumstances of the case and also taking into consideration the grievance of the petitioner, without going

into the merits of the case, this Court is inclined to pass the following order:

The 1st respondent is directed to dispose of the appeal, dated 20.09.2016, preferred by the petitioner, against orders, dated 24.09.2014, passed by the 2nd respondent, as expeditiously as possible. With the above directions, the Writ Petition is disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
