THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 32080 OF 2017 O R D E R:

This Writ Petition is filed seeking a mandamus to declare the action of the respondent police in calling the petitioner to the police station in connection with the civil disputes regarding registration of sale deeds executed by Sai Ganesh Township in Survey Nos. 108 and 99 situated at Irivada Village, Achuthapuram Mandal, Visakhapatnam District, without issuance of notice under Section 41-A of the Code of Criminal Procedure, as illegal and arbitrary. Heard learned counsel for the petitioner.

Learned Government Pleader for Home (Andhra Pradesh), on instructions, submits that no crime is registered as of now against the petitioner nor was he summoned to the Police Station, as alleged by him. She, however, assures that in case any crime is registered against him, the procedure contemplated in law will be followed.

Considering the submissions of the learned Government Pleader, the Writ Petition is disposed of with a direction to the respondent police to follow the procedure prescribed under the Code of Criminal Procedure, in the event any complaint is received against the petitioner. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
