THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO CONTEMPT CASE NO.1912 OF 2014 ORDER:
This Contempt Case is filed under Sections 10 to 12 of the Contempt of Courts Act, 1971, to punish the respondents for wilfully and deliberately disobeying the order passed by this Court, dated 05-02-2014 in W.P.No.3037 of 2014.

This Court disposed of the writ petition directing the 4th respondent-District Educational Officer to pass orders on the representation, dated 11-09-2013 submitted by the 5th respondent within a period of 8 weeks. Alleging non-implementation of the order, the present contempt case is filed.

Today, when the case is taken up for consideration, learned Government Pleader produced before this Court a copy of order, dated 13-11-2015 informing the applicant that there is no provision in the statute to convert the post of weaving instructor (aided) to the post of Physical Education Teacher and accordingly stated that it is not feasible for implementation.
4. Learned counsel appearing for the petitioner submits that the order issued is contrary to the earlier instructions. However, it is open to the petitioner to challenge the impugned order in appropriate proceedings and the issue with regard to the implementation of the earlier order or circular cannot be decided in the present contempt case.
5. Accordingly, the Contempt Case is dismissed. No order as to costs. Miscellaneous petitions, if any pending in this Contempt Case shall stand closed.
