HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.1333 OF 2009 ORDER:

This petition is filed for a writ of Mandamus declaring the condition in the notifications dated 12.01.2009 and 18.01.2009, which provide for enclosing certificate showing business turnover of five/three crores in a year, as arbitrary and illegal and for a consequential direction to the 2nd respondents to receive the application of the petitioner issue tender forms and receive the same forthwith pursuant to the notifications dated 12.01.2009 and 18.01.2009 without insisting for submission of Turnover Certificate.

This Court by order dated 29.01.2009 while admitting the writ petition directed the respondents to receive the application fo the petitioner and issue tender forms. Thereafter on 03.02.2009, this Court again gave a direction to the respondents to consider the tender offered by the petitioner along with others as per law, but without reference to condition No.2 in tender notification dated 12.01.2009 and similar condition in tender notification dated 18.01.2009.

Heard learned Government Pleader for Endowments and Sri Ch.Satish Kumar, learned counsel for the 2nd respondent. In the counter filed by the 2nd respondent it is stated that the petitioner's application was considered as per the interim orders passed by this Court and rejected the tender on 10.02.2009 as petitioner has not satisfied the other tender conditions. But, the same is not questioned by the writ petitioners. In view of the

same, the cause in the writ petition does not survive for adjudication.

Accordingly, the writ petition is dismissed as infructuous. No order as to costs.

As a sequel to the dismissal of the writ petition, Interim Orders, if any passed, shall stand dissolved. _____________________________ A.RAJASHEKER REDDY, J 07.09.2015 tk
