HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.3422 OF 2017 ORDER:

The case of the petitioner is that petitioner's father was assigned land admeasuring AC.2-00 in Sy.No.53/3 by the 4th respondent vide Ref.No.B1/77, dated 18.06.1977 and D-Form patta was also issued vide Ref.No.C217/84 dated 12.09.1984. Subsequently, the 3rd respondent issued pattadar passbook vide patta No.712. After the death of petitioner's father, petitioner was in possession of the said land. While so, the land assigned to the petitioner was submerged in the village tank and was obstructed from cultivating. The petitioner made a representation on 16.07.2007 to the respondents 2 and 3 and on 12.10.2009 to the 2nd respondent requesting him to allot alternate land.

The 2nd respondent forwarded the said representation to the 3rd respondent, who inturn sent the same to the 4th respondent asking him to conduct enquiry in the matter with the help of surveyor and see that some other land is identified. Thereafter, petitioner submitted a representation on 01.10.2014 to the 3rd respondent requesting him to take steps for allotment of the Government land identified in Surampalem Village and also Nayakampalli Village as alternate land, who inturn addressed a letter vide LDA/3033/14 dated 04.10.2014 to the 4th respondent directing him to allocate the land in Surampalem Village and also to submit the report. Inspite of the same, no action has been initiated so far. Aggrieved by the same, the present writ petition is filed.

Heard the learned counsel for the petitioner and the learned Assistant Government Pleader for Revenue.

In view of the above facts and circumstances, the respondent authorities are directed to consider the representation made by the petitioner in pursuant to the proceedings dated 04.10.2014 issued by the 3rd respondent and take action accordingly within a period of six (06) months from the date of receipt of copy of this order.

With the above direction, the writ petition is disposed of. No costs. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order.
