This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner/accused No.1 seeking anticipatory bail in connection with Crime No.123 of 2025 on the file of the Kothakota Police Station, Wanaparthy District, registered for the offences punishable under Sections 124(2), 126(2), 292, 352, 351(2) read with 3 (5) of Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS').

Heard Sri M. Vishnu Vardhan Reddy, learned counsel for the petitioner/accused No.1 and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent. 3.

One N. Balaraju has lodged a complaint before the Kothakota Police Station on 30.04.2025 stating that the members of the Fishermen Cooperative Society of their village have legally obtained permission from the concerned department to catch fish in Lakshmamma Kunta pond located in their village and on 29.04.2025 at about 8:00 hours, when

the society members went there to catch fish and after catching fish, loaded the same into the vehicle and later at 3:45 PM while he was returning to the village on foot, the petitioner/Accused No.1 along with accused Nos.2 and 3 restrained him, picked up a quarrel and threatened him to burn alive and also took petrol bottle to pour on him and on his two associates. Basing on the said complaint, a case in Crime No.123 of 2025 has been registered on 30.04.2025 on the file of the Kothakota Police Station, Wanaparthy District, for the offences punishable under Sections 124(2), 126(2), 292, 352, 351(2) read with 3 (5) of BNS.

Learned counsel for the petitioner submits that the petitioner has not committed any offence and a false case was registered against him by keeping in mind the old grudges. He further submits that the allegations made in the complaint are false and that the petitioner is a bank employee, he is ready to cooperate with the investigation.

Learned Additional Public Prosecutor submits that 12 witnesses were examined and FSL report is awaited.

The record goes to show that the petitioner has earlier filed Crl.M.P.No.200 of 2025 before the concerned Court, which came to be dismissed on 09.05.2025 with an observation that the investigation is pending. The material furnished by the Additional Public Prosecutor goes to show that almost 12 witnesses are examined and FSL report is awaited. Since the petitioner is bank employee and it appears that most of the investigation is completed, this Court is of the considered view that petitioner/accused No.1 is entitled for grant of anticipatory bail, subject to the following conditions:

1. The petitioner/accused No.1 shall surrender before the Station House Officer of Kothakota Police Station, Wanaparthy District, on or before 20.06.2025, and on such surrender, he shall be released on bail on his executing a personal bond for Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for the like sum each to the satisfaction of the said Station House Officer.

2. The petitioner/accused No.1 shall appear before the Police Station on every Sunday for a period of sixty days from 09.06.2025.

3. The petitioner/accused No.1 shall abide by the other conditions stipulated in Section 482 (2) Bharatiya Nagarik Suraksha Sanhitha, 2023 and co-operate with the Investigating Agency.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
