THE HON'BLE SRI JUSTICE P.KESHAVA RAO WRIT PETITION NO.4485 OF 2010 ORDER:
Heard the learned counsel for the petitioner as well as the learned Government Pleader appearing for the respondents. The prayer sought in the writ petition is as under: "...............Writ of Mandamus, by declaring the action of the respondent No.1 in not releasing the convict by name Uppala Bixam @ Bixamaiah. Convict No.7452 presently detained under the 2nd respondent, pursuant to G.O.Ms.No.338, Home (Prisons C) Department dated 24.07.2009, though there is no prohibition in the said G.O. for the release of the convict as illegal, arbitrary and it is further consequentially prayed that this Honourable Court may be pleased to direct the respondents to forthwith release the said convict and pass such other order............." During the course of hearing, learned Government Pleader appearing for the respondents placed on record, the written instructions issued by the Superintendent, Central Prison, Cherlapalli, enclosing a copy of the order passed by the Hon'ble Apex Court.
A perusal of the said written instructions would indicate that as per the orders of the Hon'ble Apex Court in CRLA.No.1548 of 2010, dt.11.10.2018, the petitioner herein, who is appellant in the above said Appeal was acquitted of all the charges and is ordered to be released forthwith unless his presence is required in any other case.
Pursuant to the said orders, the Superintendent, District Jail, Khammam, released the petitioner herein on 23.10.2018.
In view of the above said facts, this Court is of the opinion that no further cause would survive in the writ petition. Accordingly, the writ petition is closed. No order as to costs.
Pending miscellaneous petitions, if any, shall also stand closed.
