THE HON'BLE JUSTICE B.R.MADHUSUDHAN RAO CRIMINAL PETITION No.6735 OF 2025 ORDER:

This Criminal Petition is filed under Sections 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner/accused No.4 for grant of anticipatory bail in connection with Crime No.39 of 2025 of Narsullabad Police Station, Kamareddy District, registered for the offences punishable under Section 34(a) of the Telangana State Excise Act, 1968 and Section 8(c) read with 22(c) of Narcotic Drugs and Psychotropic Substances Act, 1985.

Heard Sri T.Srujan Kumar Reddy, learned counsel for the petitioner/accused No.4 and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent/State. 3.

It is the case of the prosecution that on 08.04.2025 at about 12:00 hours on reliable information of illegal possession and selling of adulterated toddy at Durki village and due to consumption of adulterated toddy, some persons were hospitalized, the Sub-Inspector of Police, Nasrullabad Police Station, went to the Government Hospital, Banswada and recorded the statement of the victims. After the drug test kit

panchanama, the Sub Inspector of Police, along with panch witnesses proceeded to Durki village of the house of accused No.2 and the said house was locked. While searching outside, they found 15,600 ml. of toddy and seized the said contraband under cover of panchanama. On enquiry, it is revealed that accused No.2 has adulterated the toddy by mixing Shakerin, Soapberries and Alprazolam powder in his depot situated at Durki.

Learned counsel for the petitioner submits that accused Nos.3, 7 and 8 were enlarged on anticipatory bail by the coordinate bench of this Court in Crlp.No.5344 of 2025 on 28.04.2025. He further submits that accused Nos.1 and 2 were also enlarged on regular bail by the concerned Court. Petitioner stands on the same footing as that of accused Nos.3, 7 and 8. 5.

Learned Additional Public Prosecutor submits that the prosecution was examined 22 witnesses in this case and the statements of the victims are to be recorded. 6.

The remand case dairy, dated 09.04.2025 goes to show that accused Nos.3 to 8 are toddy sellers. Petitioner is accused No.4 in the case. The report further goes to show that petitioner/accused No.4 stands on the same footing as that of

accused Nos.3, 7 and 8, who were enlarged on anticipatory bail in Crlp.No.5344 of 2025 on 28.04.2025.

Having considered the rival submissions made by the respective parties and after perusal of the material available on record, this Court is of the considered view that the petitioner/accused No.4 is entitled for grant of anticipatory bail, subject to the following conditions:

1. The petitioner/accused No.4 shall surrender before the Station House Officer of Narsullabad Police Station, Kamareddy District, on or before 20.06.2025, and on such surrender, he shall be released on bail on his executing a personal bond for Rs.30,000/- (Rupees Thirty Thousand only) with two sureties for the like sum each to the satisfaction of the said Station House Officer.

2. The petitioner/accused No.4 shall appear before the S.H.O., Narsullabad Police Station, Kamareddy District on every alternative day for a period of eight (8) weeks from 09.06.2026.

3. After release, if petitioner/accused No.4 indulges in similar offence, the respondent State is entitled to file an application seeking cancellation of bail.

4. The petitioner/accused No.4 shall abide by the other conditions stipulated in Section 482 (2) Bharatiya Nagarik Suraksha Sanhitha, and shall co-operate with the Investigating Agency.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
