ORDER :
Heard learned counsel for petitioners and Sri P.Kesava Rao, learned standing counsel for respondent GHMC and with their consent, the writ petition is taken up for disposal at the admission stage.
2. This writ petition is filed questioning the action of the 1st respondent in not taking action on the representations of the petitioners dated 02.09.2010, 06.06.2012 and 07.07.2015 regarding illegal constructions made by 2nd respondent in parking place and also pent house over the terrace against the sanctioned plan, as illegal.
3. Petitioners claim that they are the absolute owners of the flats bearing No.F1,F1,F1,D1,D2,F2 and the same were purchased by them from the 2nd respondent who is a builder under registered sale deeds. The grievance of the petitioners is that 2nd respondent is constructing in the parking place and a pent house over the terrace due to which there is a threat of collapsing the building and danger to the persons living in it. Petitioners have submitted representations dated 02.09.2010, 06.06.2012 and 07.07.2015 to the 1st respondent requesting to take action against the illegal constructions, however no action is taken thereon and the same is pending. Since no action is being taken by the officials of respondent corporation, the present writ petition is filed.
4. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the 1st respondent to expeditiously dispose of the above representations.
5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the 1st respondent to consider the representations of the petitioners dated 02.09.2010, 06.06.2012 & 07.07.2015 and pass appropriate orders as warranted under law within a period of six weeks from the date of receipt of copy of this order and communicate the decision to the petitioners. It is needless to mention that prior notice and opportunity of hearing be afforded to 2nd respondent. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed.
