M/S Vigilance Enforceemnt For Indian Copy Rights, v. The State Of Telangana
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.16484 of 2019 ORDER:
This writ petition is filed with the following prayer: ".....to issue writ order or direction more particularly one in the nature of writ of mandamus declaring the inaction of the respondents in considering the applications dated 11.5.2018, 12.6.2019, 25.6.2019, 09.7.2019 for appointment of Special party force for effective implementation of provisions of copy Rights Act, 1955, Cable Television Net work (Regulation) Act 1955 and Cable Television Regulation Act 1995 as per the GO ms No.41 Home (Genl.A) Department dated 8.2.2011 and GO Ms No.183 Revenue (CT-II) Department, 21.7.2016 as arbitrary and illegal consequently direct the respondents to consider the applications dated 11.5.2018, 12.6.2019, 25.6.2019, 09.07.2019 for appointment of Special party force for effective implementation of provisions of copy Rights Act, Cable Television Net work (Regulation) Act 1955 and Cable Television Regulation Act 1995 and pass such other order or orders may deem fit and proper in the circumstances of the case."
Learned Government Pleader for Home filed counter affidavit on behalf of respondent No.2 stating that pursuant to the representation of the petitioner dated 25.06.2019, this respondent issued Memo vide C.No.77/C1/KNR/2019, dated 29.06.2019 to all the Police Officers for taking necessary action as per law, whenever any complaints of Copy Rights violations are reported in the police stations.
Respondents 3 and 4 have not filed any counter affidavit. Heard learned counsel for the petitioner, who, submits that the writ petition may be disposed of directing respondents 3 and 4
to consider the representations of the petitioner dated 11.5.2018, 12.6.2019, 25.6.2019, 09.07.2019.
In view of the same, this writ petition is disposed of directing respondents 3 and 4 to dispose of the representations of the petitioner within a period of four weeks from the date of receipt a copy of this order and take action in accordance with law. As a sequel, miscellaneous petitions, if any, pending shall stand closed.
