ORDER
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') for grant of prearrest bail to the petitioners, who are arrayed as accused Nos.2 and 3 in Crime No.892 of 2025 before the Attapur Police Station,
Hyderabad, registered for the offences punishable under Section 108 of BNS.

The brief facts of the case are that on 22.10.2025, the de facto complainant appeared before Attapur Police Station and stated that the deceased had fallen in love with Accused No.1 and subsequently married her in the presence of elders. After the marriage, the deceased brought his wife to Hyderabad, where they initially resided at Narsingi for a few days and later shifted to a rented house in Rambhag Colony, Attapur. Both of them were working in a dry-cleaning shop. On 02.10.2025, accused No.1 went to her mother's house to attend a family function. On 20.10.2025, at around 11:00 PM, the deceased called the complainant over the phone and informed that he was going to die, after which the call was disconnected and his phone was found switched off. Being alarmed, the complainant approached the police seeking necessary action. Based on the complaint, a case was registered in Crime No.892/2025 under Section 194 of the BNSS. Subsequently, the case was revived, and the present petitioners were arrayed as Accused Nos. 2 and 3.

Heard Sri Soma Srinath Reddy, learned counsel appearing on behalf of the petitioners as well as Sri M.Rama Chandra Reddy,
learned Additional Public Prosecutor appearing on behalf of the respondent - State.

Learned counsel for the petitioners submitted that the petitioners are innocent of the alleged offences and have been falsely implicated in the present case. He contended that the petitioners are in no way connected with the alleged recovery. It is further submitted that accused No.1 has already been released on bail, and therefore, the continued apprehension of arrest of the present petitioners is unwarranted. The learned counsel also argued that there are no specific allegations attracting the provisions of Section 108 of the BNS against the petitioners. He further submitted that the petitioners are ready and willing to cooperate with the investigation at all stages. Accordingly, he prayed that this Court may be pleased to grant pre-arrest bail to the petitioners.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioners, contending that the allegations against the petitioners are serious in nature and therefore, they are not entitled to the relief of bail. He further submitted that it was under the influence of the present petitioners that accused No.1 abetted the deceased,
which ultimately led to suicide by the victim. Accordingly, he prayed that this Court may be pleased to dismiss the Criminal Petition.

In the light of the submissions made by both the learned counsel and upon perusal of the material available on record, it appears that the case was registered in Crime No.892 of 2025. The only allegation against accused Nos.2 and 3 is that they allegedly influenced accused No.1, pursuant to which the victim is stated to have committed suicide. Considering the stage of investigation insofar as accused Nos.2 and 3 are concerned and also taking into account that accused No.1 has already been enlarged on bail. Considering the facts and circumstances of the case, this Court deems it fit to grant pre-arrest bail to the petitioner, subject to the following conditions:
i.
The petitioners shall surrender before the Station House Officer, Attapur Police Station, Hyderabad, within two weeks from today, and on such surrender, the said Station House Officer shall release him on bail on executing a personal bond for Rs.25,000/-, each with two sureties, for the like sum each.
ii.
The petitioners shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioners shall appear before the concerned Investigating Officer on every Monday between 09:00 a.m, and 05:00 p.m., for a period of eight (8) weeks or till the filing of the charge sheet, whichever is earlier and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
