Yes/No THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CRIMINAL PETITION No.7405 of 2015 ORDER :

This criminal petition under Section 482 of the Code of Criminal Procuedure, 1973 ('the CrPC', for brevity) is filed by A1 and A2 in C.C.No.210 of 2003 on the file of the VI Metropolitan Magistrate, Cyberabad at Medichal, Ranga Reddy District requesting to quash the proceedings against them in the above calendar case.

2. Heard the learned counsel for the petitioners/A1 and A2 and learned Additional Public Prosecutor representing the 1st respondent/State. Perused the material record.

3. During the course of hearing, it is represented by the learned counsel for the petitioners that the criminal petition may be disposed of by an appropriate order dispensing with the presence of petitioner No.2/A2 and with a further direction to the trial Court to dispose of the application filed under Section 239 Cr.P.C., which is pending since a long time.

4. Having regard to the submissions, this Court is satisfied that the presence of the 2nd petitioner/A2 can be

dispensed with for the present.

5. In the result, the criminal petition is disposed of dispensing with the presence of petitioner No.2/A2 in C.C.No. 210 of 2003 on the file of the VI Metropolitan Magistrate, Cyberabad at Medichal, Ranga Reddy District. However, petitioner No.2/A2 shall appear before the trial Court as and when directed by the trial Court. It is needless to mention that the 1st petitioner/A1 shall appear before the trial Court during the course of trial. The trial Court is directed to dispose of the application filed by the petitioners under Section 239 Cr.P.C. within a month from the date of receipt of a copy of this order.

Miscellaneous Petitions pending, if any, shall stand closed.
