Heard.
The petitioner herein is aggrieved by the demand notice issued to him by the 3rd respondent on 28-02-2015. The petitioner has already filed an appeal under Rule 35/35-A of the Mines and Minerals (Development and Regulation) Act, 1957 on 27-03-2015 against the said order by approaching the appellate authority. The said appeal along with the stay application is stated to be pending before the 2nd respondent since then. Aggrieved by non-consideration of the stay application, the present writ petition is filed.
Learned counsel for the petitioner states that the date of hearing of the appeal was fixed on 18-04-2015 vide proceedings of the 2nd respondent, dated 09-04-2015, but on the schedule date i.e., 18-04-2015 no orders were passed either in the stay petition or in the appeal.
Since the petitioner's grievance is only with respect to non-consideration of his request with regard to stay application pending in the appeal, I deem it appropriate to dispose of the writ petition by directing the 2nd respondent to consider and pass appropriate orders on the stay application filed by the petitioner within two weeks from the date of receipt of a copy of this order and thereafter decide the appeal expeditiously.
Accordingly, the Writ Petition is disposed of. No order as to costs. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. _______________________ VILAS V.AFZULPURKAR, J Date: 27-04-2015
