THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY C.R.P.NO.1115 OF 2020

O R D E R

The petitioners are the plaintiffs, and they filed O.S.No.192 of 2018 on the file of XVI Additional District Judge, Rangareddy District at Malkajgiri, for partition and separate possession in respect of A and B schedule properties. They filed I.A.No.16 of 2018 in the said suit, for grant of ad-interim injunction restraining the respondents/defendants from proceeding with the construction work in petition A schedule property till the disposal of the suit. The grievance of the petitioners is that though notices have been ordered, the trial court is not taking up the interlocutory application for disposal. Aggrieved by the same, the present revision petition is filed.

Learned counsel for the petitioners would submit that taking advantage of nondisposal of I.A.No.16 of 2018, respondents are proceeding with the construction in the petition A schedule property, and are trying to alienate the same. Since the prayer of the petitioners is innocuous, and they are only seeking for disposal of I.A.No.16 of 2018 in O.S.No.192 of 2018, this court is inclined to dispose of the revision at the stage of admission.

In view of the same, without expressing any opinion on merits, revision petition is disposed of directing the trial court to dispose of I.A.No.16 of 2018 in O.S.No.192 of 2018 in accordance with law, within a period of four weeks from the date of receipt of a copy of this order without fail.

Interlocutory applications pending, if any, shall stand closed. No costs. ------------------------------------------------ A.RAJASHEKER REDDY,J DATE:11-11-2020 avs
