ORDER:

Heard learned Counsel for the petitioner and learned Government Pleader for the respondents.

The petitioner was appointed as a Fair Price Shop Dealer for shop No. 44 of Sankavarappadu Village, Addanki Mandal, Prakasam Disttrict . While so on 23.3.2015 the fourth respondent inspected the shop of the petitioner and did not find any variation in the stock. However he seized 4.50 quintals of rice in Chinnakothapalli village under panchanama dated 23.3.2015 and pursuant to the same, the petitioner stated that the said stock does not belong to her shop. However, it was noticed that 32 card holders did not draw their quota of PDS rice for the month of March, 2015, but in the sales register, 32 card

holders' names were entered as if they drawn their quota of rice. In these circumstances, impugned order dated 30.03.2015 was passed by the second respondent suspending the authorization of the petitioner pending enquiry. Simultaneously, a show cause notice was also issued on 30.03.2015. Challenging the same, the present Writ Petition is filed. In view of the allegations made against the petitioner in the impugned order and show cause notice dated 30.03.2015 stating that the dealer/petitioner has diverted PDS rice to the black market and that she has made fictitious entries of 32 card holders in the sales register for March, 2015, this Court is not inclined to interfere with the same at this stage. The petitioner is given fifteen days time from the date of receipt of a coy of this order to submit her explanation to the show cause notice dated 30.3.2015 and the second respondent is directed to complete the enquiry within 60 days from the date of receipt of the explanation from the petitioner by duly following the principles of natural justice.

The Writ Petition is accordingly disposed of. As a sequel thereto, the miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed. No order as to costs. --------------------------------------------------- JUSTICE A.RAMALINGESWARA RAO Dated 1st July, 2015.
