THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 30622 of 2012

ORDER:

The petitioner in this case was aggrieved by the proceedings dated 31.08.2012 issued by the A.P. State Commission for SCs and STs, Hyderabad, whereby the officer on special duty of the said Commission requested the Commissioner of Police, Hyderabad City, to cause an enquiry into the allegations made by one M. Laxman, Vidyanagar, Hyderabad, the 4th respondent herein, to the effect that the petitioner herein had arrested and threatened the said Laxman by filing a false case before the learned Principal Rent Controller, Hyderabad, and to initiate stringent action as per the provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989. Initially, this Court granted interim stay of the impugned proceedings on 03.10.2012 and the said order was extended from time to time up to 23.11.2012. There was no extension thereafter. However, it is stated that no action was taken by the police authorities against the petitioner herein even after expiry of the interim order.

The Inspector of Police, Kachiguda Police Station, Hyderabad City, filed a counter affidavit stating that upon enquiry into the matter pursuant to the letter addressed by the Commission, it emerged that the allegations made by the complainant, the 4th respondent herein, were false. A detailed report was submitted to the Commissioner of Police, Hyderabad City, by the Assistant Commissioner of Police, Kachiguda Division, Hyderabad, under letter dated 25.10.2012. As the contents of the 4th respondent's complaint were found to be without basis, no action was required to be taken against the petitioner. In the light of the afore-stated stand of the police authorities, the petitioner need have no apprehension that the police authorities would proceed against him on the basis of the impugned proceedings dated 31.08.2012 of the A.P. State Commission for SCs and STs, Hyderabad.

The writ petition is therefore closed.

Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs.
