Heard learned counsel for the petitioner and learned Government Pleader for Revenue appearing for the respondents. 2.

Petitioner alleges that she was granted D-Form Patta for the land to an extent of Ac.0.30 cents in Survey No.49/12 and Ac.0.79 cents in Survey No.33/2A of Kuramaipalli Village, Bangarupalem Mandal, Chittoor District.

She now apprehends that the respondents are trying to dispossess her from the land assigned to her without following due process.

It is the assertion of petitioner that D-Form Patta was granted to her in the year 2005 and the same is subsisting. If that is so and if so far no proceedings are issued against the petitioner, the Writ Petition itself is misconceived. It is in the form of pre-emptive litigation to prevent the authorities concerned from taking appropriate steps as warranted by law. Petitioner cannot allege dispossession without following due process even before action is taken against her. It is needless to observe that petitioner is not remediless, if any adverse decision is taken against her without following due process of law.
