HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO W.P.No.2536 of 2017 ORDER:

Since the application of the petitioners herein seeking police aid was dismissed by the Civil Court on 29-04-2016 in I.A.No.123 of 2016 in I.A.No.153 of 2013 in O.S.No.26 of 2013 on the file of the Senior Civil Judge, Narsipatnam, the petitioners are bound to question the same only under the C.P.C. and not under Article 226 of the Constitution of India having regard to the law declared by the Supreme Court to this effect in Radhey Shyam and Others Vs. Chhabi Nath and Others1.

Therefore, this Writ Petition is dismissed as withdrawn granting liberty to the petitioners to challenge the said order denying police aid to the petitioners by way of a Revision under the provisions of the CPC.

As a sequel, the miscellaneous petitions pending, if any, shall stand closed.
