HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.45271 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India challenging the imposition of conditions particularly condition No.1 on accused No.10 by the Special Judge for Andhra Pradesh Protection of Depositors of Financial Establishment Act-cum-Principal District & sessions Judge, West Godavari, Eluru, while granting bail. 2.

While granting bail to accused No.10 in Crime No.3 of 2015 of Peddapadu Police Station, the learned Special Judge imposed some conditions. Aggrieved by condition No.1, this writ petition is filed by the brother of Accused No.10. The condition No.1 imposed by the learned Special Judge is as follows:

"A8 to A10 are ordered to be released on bail on each of them executing a personal bond for Rs.5 lakhs with two solvent sureties for the like sum each with personal bonds in the form of bank guarantee". 3.

Heard and perused the material available on record. 4.

Considering the facts and circumstances of the case, the above condition imposed on accused No.10 in the above crime is modified as follows:

"A10-Md. P.L.A Khan is ordered to be released on bail on condition of his furnishing a bank guarantee of Rs.1,00,000/- (Rupees One lakh only) with two solvent sureties for the like sum each. Rest of the conditions imposed by the learned Special Judge shall remain."
