Ganta Papa Raju v. Commissioner, Endowments Department
HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.19636 OF 2009
O R D E R
This writ petition is filed challenging the action of the 1st respondent in appointing Non-Hereditary trust board vide proceedings No.G2/27980/09 dated 08.09.09.
At the time of admission, this Court granted interim order for a period of eight weeks. Thereafter it was extended from time to time and ultimately on 22.12.2009, it was extended for a period six weeks. Later there was no extension.
Smt K. Lalitha, learned Standing counsel for respondents submits that as per Section 17(2) of Andhra Pradesh Charitable and Hindu Religious Institutions and Endowments Act, 1966 (for short 'the Act') the term of the trust board members is only for a period of two years, as such by efflux of time, the impugned order worked out itself. Hence, the cause in the writ petition does not survive for adjudication and has become infructuous.
Recording the aforesaid submission, the writ petition is dismissed as infructuous. Any interim order granted earlier shall stand vacated. There shall be no order as to costs. As a sequel, miscellaneous petitions pending if any, shall stand closed.
