THE HONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No.6767 of 2025 ORDER:
This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') seeking anticipatory bail to the petitioner/accused in Crime No.619 of 2025 on the file of the Narsingi Police Station, Cyberabad, registered for the offences punishable under Section 69 of the Bharatiya Nyaya Sanhitha, 2023 (BNS). 2.
The case of the prosecution is that on 25.03.2025 at 20:00 hours, the victim lodged a complaint stating that she was in a relationship with the petitioner/accused, an employee at Google, Nanakramguda. They reconnected via Instagram in April 2024, after initially meeting two years ago through a mutual friend. The accused expressed love and assured marriage, following which they frequently met and engaged in physical relations, allegedly based on repeated promises of marriage. Over time, the accused began avoiding her, questioned her salary, and delayed marriage discussions. On 23.03.2025, when the victim and her mother visited the accused parents in Warangal, they were asked to wait, later threatened, and the marriage was out rightly denied. The victim alleges that
the accused deceived her into physical relations under the false promise of marriage. Basing on the same, Crime No.619 of 2025 was registered.

Heard Sri N.Bhavani Sankar, learned counsel for petitioner and Mr.Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent-State.

Learned counsel for petitioner submitted that petitioner has not committed alleged offence and he was falsely implicated in the above crime. He further submitted that even according to the allegations made in the complaint, the petitioner and the de-facto complainant are known to each other since April, 2024 and are in relationship, hence the ingredients under Section 69 of BNS are not attracted against the petitioner. He further submitted that when the de-facto complainant demanded money illegally from the father of the petitioner, the petitioner's father lodged a complaint on 24.03.2025 before the Station House Officer, Subedari Police Station. When the said complaint is pending investigation, the de-facto complainant lodged the present complaint as a counter blast on 25.03.2025. He further submitted that the petitioner is a software employee and is not having any other criminal antecedents and he is ready and
willing to cooperate with the investigation and also ready to abide by the conditions, which are going to be imposed by this Court and hence, prayed for grant of anticipatory bail. 5.
Per contra, learned Additional Public Prosecutor submitted that petitioner has committed grave offence and investigation is under progress and if the petitioner/accused is granted anticipatory bail at this stage, he may tamper with the evidence and may threaten the witnesses, and hence, prayed to dismiss the petition.

Having considered the rival submissions made by the respective parties and after perusal of the material available on record, it reveals that the petitioner and the de-facto complainant are known to each other since April, 2024. Even according to the learned Additional Public Prosecutor, petitioner is not having any other criminal antecedents. 7.
Taking into consideration the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner/accused subject to the following conditions:
1. The petitioner/accused shall surrender before the Station House Officer of Narsingi Police Station, Cyberabad, on or before 17.06.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused on bail on his
executing a personal bond for Rs.30,000/- (Rupees Thirty Thousand only) with two sureties, for the like sum each.
2. The petitioner/accused shall appear before the concerned SHO at 11.00 A.M. on every Saturday, for a period of eight (8) weeks, or till filing of charge sheet whichever is earlier, for the purpose of investigation and thereafter, as and when required.
3. The petitioner/accused shall not try to influence any of the prosecution witness in any manner or directly or indirectly try to contact the de-facto complainant or her family members.
4. The petitioner/accused shall abide by the other conditions stipulated in Section 482 (2) Bharatiya Nagarik Suraksha Sanhitha, 2023 and co-operate with the Investigating Officer in investigating the case.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
