This Criminal Petition under Section 438 of Cr.P.C. is filed by the petitioner, who is A.1, seeking anticipatory bail in Crime No.326 of 2019 of KPHB Colony Police Station, Cyberabad, Ranga Reddy District, registered for the offences punishable under Sections 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act.
This is a case of physical and mental harassment of the defacto complainant by the petitioner/A.1 along with other accused for additional dowry. Basing on the complaint lodged by the victim, the police registered Crime No.326 of 2019 for the aforesaid offences against the petitioner/A.1 and other accused.
Heard learned counsel for the petitioner/A.1 and the learned Additional Public Prosecutor appearing for the respondent-State. Perused the material on record. Learned counsel for the petitioner contends that the allegations levelled against the petitioner are all false and frivolous and the complainant is being tutored by her father and she did not even allow the petitioner to celebrate the birthday of the girl child nor allowed his parents to stay with the new born child for some time. It is also contended that the complainant is neither willing to join the company of the
GSD, J Crl.P.No.4530 of 2019 petitioner nor willing to take divorce from him. It is also contended that A.2 and A.3 in the above crime were already granted anticipatory bail by the Court concerned vide order dt.08.07.2019 in Crl.MP.No.3115 of 2019. It is contended that the petitioner is ready to abide by any of the conditions imposed by this Court and would cooperate with the investigation, if he is released on anticipatory bail in the event of his arrest in connection with the aforesaid crime. On the other hand, the learned Additional Public Prosecutor opposed the relief sought in the above petition. As seen from the contents of the complaint, there are specific allegations levelled against the petitioner regarding dowry harassment.
In view of the specific and serious nature of allegations levelled against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. However, if the petitioner/A.1 surrenders before the Court below concerned within fifteen (15) days from today and moves an application for regular bail, after giving prior notice to the Public Prosecutor concerned, the said application shall be considered in accordance with law.
With the above observations, this Criminal Petition is dismissed.
As a sequel, miscellaneous petitions pending, if any, shall stand closed.
