This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioners/accused Nos.4 and 5 for grant of anticipatory bail in connection with Crime No.1629 of 2024 of Narsingi Police Station, Cyberabad Commissionerate, registered for the offences punishable under Sections 318(4), 338, 336(3), 340(2), 61(2) of Bharatiya Nyaya Sanhita, 2023 (for short, 'BNS'). 2.

Heard Sri N.Bhavani Sankar, learned counsel for the petitioners/accused Nos.4 & 5 and Sri Syed Yasar Mamoon, learned Additional Public Prosecutor for the respondent/State. 3.

P.Ram Mohan/de-facto complainant has lodged a complaint before Narsingi Police Station, Cyberabad Commissionerate on 08.11.2024 stating that his father purchased schedule property i.e., open plot bearing No.114, admeasuring 500 Square yards in Brindavan Colony, and his father was in peaceful possession and enjoyment of the schedule property since long time. On 20.10.2024, when the de-facto complainant went to the schedule property, he came to know that some third persons are

interfering over the schedule property, thereby he obtained E.C. of the schedule property and he came to know that the property was registered in the name of the third parties through G.P.A holder. Basing on the same, a case was registered vide Crime No.1629 of 2024 before the Narsingi Police, Cyberabad, for the offences punishable under Sections 318(4), 338, 336(3), 340(2), 61(2) of BNS.

Learned counsel for the petitioners submits that petitioners have acted as witnesses to the registered sale deed dated 18.07.2024 vide document bearing No.11089 of 2024 before the Sub-Registrar, Gandipet Mandal, Ranga Reddy District. He further submits that A2 was granted anticipatory bail vide Crl.P No.13774 of 2024 on 19.11.2024 by Co-ordinate Bench of this Court. Petitioners are apprehending arrest in the hands of police and prayed to grant anticipatory bail.

Learned Additional Public Prosecutor submits that petitioners are shown as A4 and A5 in the crime and two witnesses were examined in the case and A1 to A3 with active collusion of others created fictitious documents to grab the property.

On perusal of the FIR dated 08.11.2024, the names of the petitioners does not reflect. The instructions submitted by learned Additional Public Prosecutor goes to show that petitioners are shown as A4 and A5 who signed as witnesses to the sale deed. Record goes to show that A2 was granted anticipatory bail vide Crl.P No.13774 of 2024 dated 19.11.2024. Material goes to show that the petitioners/A4 and A5 stood as witnesses to the sale deed. As the petitioners are apprehending arrest in the hands of the police, since they acted as witnesses to the document and have made out a case for grant of anticipatory bail.

Accordingly, this petition is allowed granting anticipatory bail to the petitioners subject to the following conditions: i. The petitioners/accused Nos.4 and 5 shall surrender before the Station House Officer of P.S.Narsingi, within two weeks from today, and on such surrender, the said Station House Officer shall release them on bail on executing a personal bond for Rs.20,000/- with two sureties, for the like sum each.

ii. The petitioners/accused Nos.4 and 5 shall abide by the other conditions stipulated in

Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023 and co-operate with the Investigating Officer in investigating the case.

Miscellaneous applications, pending if any, shall stand closed.
