HON'BLE SRI JUSTICE S.V.BHATT W.P. No.9005 OF 2013 ORDER:

The petitioners pray for the following relief: " ... Writ of Mandamus, declaring the inaction on the part of the respondents in conducting investigation and taking appropriate action in compliance with the mandatory procedure as contemplated under the provisions of Cr.P.C., in pursuance of FIR No. 221 of 2012, FIR No. 32 of 2012 and FIR No.56 of 2013 of Golconda P.S., Hyderabad for the offences under Sections 120-B, 324, 354, 506 read with Section 34 IPC as arbitrary, illegal, unfair, unjust and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to investigate and submit reports before the concerned Courts in the interest of justice..." The Assistant Government Pleader, on instructions, submits that insofar as Crime No.

221/ 2012 under Sections 120-B, 324, 354, 506 IPC is concerned, investigation was completed and after completion of the investigation, the investigation officer referred the complaint as " Civil in Nature" dated 10.12.2013 and accordingly final report was also filed before the learned Magistrate. Insofar as Crime No.32/ 2012 under Sections 500, 384 r/ w 34 IPC is concerned, investigation was completed and after completion of the investigation, the investigating agency referred the said complaint as " Lack of Evidence" dated 20.06.2014 and accordingly final report was also filed before the learned Magistrate. Insofar as Crime No.56/ 2013 under Section 324 r/ w.34 IPC is concerned, after completion of the full-fledged investigation into the case, charge sheet has been filed and the same was taken on file vide C.C.

No.944 of 2015 and the accused in the FIR are facing trial. In view of the above facts and circumstances, the writ petition deserves no consideration.

The statement is placed on record and the writ petition is dismissed. No order as to costs.
