THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CIVIL REVISION PETITION No.3919 of 2013 ORDER:
This civil revision petition is filed by the petitioner under Article 227 of the Constitution of India challenging the orders in I.A.No.266 of 2013 in I.A.No.254 of 2011 in R.C.No.311 of 2010 on the file of the Court of I Additional Rent Controller, City Small Causes Court, Hyderabad.
Heard both the counsel.
At the time of arguments, both the counsel with one voice submitted that the petitioner filed I.A.No.254 of 2011 under Section 45 of the Indian Evidence Act. For one reason or other, the trial Court has not disposed of that application. During pendency of I.A.No.254 of 2011, the trial Court allowed I.A.No.266 of 2013. Both the counsel with one voice further submitted that the trial Court may be directed to dispose of I.A.No.254 of 2011 as expeditiously as possible.
In view of the submissions made by both the counsel, this Court is not inclined to express any opinion with regard to the validity or other wise of the orders dated 17.08.2013 in I.A.No.266 of 2013. Having regard to the facts and circumstances of the case, the First Additional Rent Controller, City Small Causes Court, Hyderabad, is hereby directed to dispose of I.A.No.254 of 2011 as expeditiously as possible, preferably, within a period of one month
from the date of receipt of copy of this order in accordance with law.
With the above observation, Civil Revision Petition is disposed of. As a sequel, the miscellaneous petitions, pending if any, shall stand closed.
