HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 3426 of 2004 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the respondent in issuing proceedings dated 02.01.2004 placing the petitioner under suspension with immediate effect pending enquiry into the charges.

When the matter is taken up for hearing, learned standing counsel for the respondent submits that subsequent to the impugned proceedings, disciplinary action was initiated against the petitioner and he was removed from service. In view of the same, the cause in the writ petition does not survive.

Having considered the said submission, this Court is of the view that the suspension orders have been merged with that of removal orders and, therefore, the cause in the writ petition does not survive.

Accordingly, the writ petition is dismissed. No order as to costs. Consequently, pending miscellaneous applications, if any, shall stand closed.
