THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4665 of 2018 ORDER:

This Criminal Petition, under Section 438 Cr.P.C., is filed to enlarge the petitioners/ A.1 to A.4 on bail in the event of their arrest since they are apprehending arrest in connection with FIR No.11 of 2018 on the file of Vidavalur Police Station, S.P.S.R. Nellore District, registered for the offences under Sections 323, 324, 506 r/ w 34 IPC and Sections 3 (1) (r), 3 (1) (s) and 3 (2) (va) of SCs and STs ( POA) Act.

After arguing the matter for awhile, learned counsel for the petitioners, requested this Court to direct the concerned to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1 In view of the request made by the learned Counsel for the petitioners, the Police of Vidavalur Police Station, S.P.S.R. Nellore District, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Arnesh Kumar v. State of Bihar and another.

With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
