THE HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION NOs.6269, 6270 AND 6271 OF 2021 COMMON ORDER:

Since these three Criminal Petitions arise out of same crime number, they are taken up together for disposal. These three Criminal Petitions, under Section 438 of the Code of Criminal Procedure, 1973, are filed by the petitioners/A-7 (Crl.P.No.6269 of 2021), A-11 (Crl.P.No.6270 of 2021) and A-12 (Crl.P.No.6271 of 2021) respectively seeking to grant anticipatory bail in the event of their arrest in connection with Crime No.278 of 2019 of P.S. Gopalapuram, Secunderabad, registered for the offence punishable under Section 420 read with Section 34 of the Indian Penal Code.

Heard the learned counsel appearing for the petitioners/A-7, A-11 and A-12, learned Assistant Public Prosecutor appearing for the respondent-State and perused the record.

Learned counsel for the petitioners/A-7, A-11 and A-12 would submit that the petitioners are innocents of the offence alleged against them and have been falsely implicated. The petitioners are having fixed abode and there is no question of absconding. It is further submitted that the petitioners/A-7, A-11 and A-12 are willing to furnish suitable security and abide by any condition which this Court may deem fit to impose in the event of granting anticipatory bail. Hence, it is prayed that the petitioners/A-7, A-11 and A-12 be granted anticipatory bail. Learned Assistant Public Prosecutor opposed to grant anticipatory bail to the petitioners/A-7, A-11 and A-12.

On perusal of the material papers, it is seen that the amounts of Rs.22,00,000/-, Rs.2,00,000/- and Rs.3,00,000/- were transferred to the petitioners/A-7, A-11 and A-12 respectively by way of cash as well as account transfers and there is no specific answers on the part of the accused as to how these amounts have been transferred to their accounts.

The allegations levelled against the petitioners/A-7, A-11 and A-12 are grave and serious in nature.

Looking into the nature of allegations, the involvement of the petitioners/A-7, A-11 and A-12 in commission of the crime and the other facts and circumstances, I am not inclined to release the petitioners on anticipatory bail.

The three Criminal Petitions are dismissed. However, the petitioners/A-7, A-11 and A-12 are directed to surrender before the Court concerned within fifteen days from today, failing which, the police shall take coercive measures against them. Miscellaneous applications, if any, pending shall stand dismissed.
