The petitioner/accused filed the present application under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, seeking to grant bail to him in Crime No.100 of 2026 of Osmania University Police Station, Hyderabad, which was registered for the offences punishable under Sections 376(2) (n) of IPC, 77, 78 and 351(2) of BNS, 2023, 5(1) r/w. 6 of POCSO Act, 2012 and 66E and 67A of the I.T. Act. 2.

Heard Mr. Nagesh Komati, learned counsel for the petitioner and Mr. M.Vivekananda Reddy, learned Assistant Public Prosecutor appearing for the respondent-State.

The allegation against the petitioner/accused is that he committed sexual intercourse over the minor victim girl multiple

times under the guise of love and when the victim girl refused to continue the relationship, he shared her private pictures on social media and whatsapp groups.

Learned counsel for the petitioner submits that the petitioner and the victim were in relationship and they have participated in consensual sex. Hence, the ingredients of the offences alleged against the petitioner are not at all attracted. He further submits that the entire investigation is completed and charge sheet was also filed before the trial Court and the petitioner is in judicial custody since 19.03.2026. Hence, he prayed to grant bail to the petitioner. 5.

On the other hand, learned Assistant Public Prosecutor opposed for grant of bail to the petitioner stating that specific allegations are levelled against the petitioner. 6.

In the light of the submissions made by both the learned counsel and on a perusal of the material on record, it is evident that the entire investigation was completed and charge sheet was already filed before the trial Court and the petitioner is in judicial custody since 19.03.2026. Considering the facts and circumstances of the case and the incarceration period of the petitioner, this Court deems it fit to grant bail to the petitioner/accused, subject to the following conditions:

i. The petitioner shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the Special Judge for Trial of Cases under POCSO-cum-XII Additional Sessions Judge, Hyderabad.

ii. The petitioner shall appear before the concerned SHO at 11:00 a.m., on every Monday for a period of eight (8) weeks and thereafter, as and when required.

iii. The petitioner shall abide by the conditions stipulated in Section 437(3) of Cr.P.C.

(presently, Section 480(3) of the BNSS).

Accordingly, this Criminal Petition is allowed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
