HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.26657 OF 2017 ORDER:

This petition is filed for a writ of Mandamus declaring the action of the respondents 3 and 4 in not considering petitioners' application as recommended by the 5th respondent management for absorbing them into aided posts, and in not releasing the Gran-inaid against their names and on the other hand in directing the Management to go ahead with fresh recruitment as arbitrary and illegal and for a consequential direction to the respondents to treat the petitioners being appointed in Aided posts from the date of their initial appointment and release Grant-in-Aid against their names with all consequential benefits.

Learned counsel for the petitioners submits that petitioners were appointed in the years 2009 and 2013, respectively and working on temporary basis; that the ban imposed by the Government in the year 2004 on recruitment of staff in various Departments throughout the State, was lifted; and that petitioners filed representation dated 25.12.2016 requesting to absorb them in the vacant aided posts. He also submits that the 5th respondent is a minority institution.

Heard learned Assistant Government Pleader for School Education who submits that petitioners were not appointed initially as per the Rules in force and that no proposals were sent by the 5th respondent for filling up of the vacant aided posts.

The same is disputed by the learned counsel for the petitioners.

Since it is stated that the representation of the petitioners for absorption is pending before the competent authority, without expressing any opinion on merits, the competent authority is directed to dispose of the representation of the petitioners dated 25.12.2016, by taking into account the aforesaid aspects, in accordance with law.

Accordingly, the writ petition is disposed of. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
